NEACH is excited to offer a three-part series that dives into the ins and outs of checks. In this session, Part 2 of the series, we explore the return and adjustment process.

Making the decision to pay or return a check item is one of the critical responsibilities that rests with the paying institution. Returns must be handled expeditiously under Reg CC and in conjunction with the Uniform Commercial Code to avoid losing the right to return. But just because the institution decides to not return doesn’t mean that the story ends there. In fact, there can be a lot more options available depending on what factors are at play. The adjustment process is frequently used to resolve issues that come up after posting. Examples of this include encoding errors, duplicate presentment, and even missing endorsement. On top of this, institutions can assert warranty breaches directly to attempt to resolve situations outside of the typical check exchange such as for scenarios in which the Reg CC RDC Indemnity has been breached along with many others.

In this session, we explore this topic in detail discussing which rules, laws, and regulations apply to the return and adjustment process and then also talk about different methods of return, adjustment, and dealing direct. We will also use case studies to apply what we learn to real-life situations that institutions are likely to experience.
