To adjust or to return, that is the question! Timely check returns refer to understanding the applicable warranties at play and making a decision that meets Regulation CC and UCC timely and expeditious return requirements. The adjustment process allows for more flexibility but comes with the challenge of losing the right to return. In general, the allocation of losses related to alteration and forgery are distributed between the depository and paying institutions. Navigating all these decision points can prove challenging for a financial institution and making the wrong decision can come with potentially costly consequences. For example, choosing to adjust for a reason that is outside of permissible timelines can result in a paying institution taking a loss. On the flip side, not negotiating an instrument correctly can make a depository institution liable to a loss.

In this session, we cover topics that help demystify returns vs. adjustments. Topics to be covered include check warranties, the return process, the adjustment process, warranty claims, forgeries vs. alterations, and overall check governance at play.
