Last year, the Consumer Financial Protection Bureau (CFPB) promised to "prioritize" rulemaking and enforcement actions based on consumer complaints; and, because nearly 1/3 of those complaints are related to debt collection, you can expect the collections industry to undergo changes in the near future! Until these imminent rules are issued, creditors must rely on previous enforcement actions and various guidance documents on debt collection to determine: (1) what (potentially) qualifies as an unfair or deceptive abusive act or practice (UDAAP); and, (2) how to remain in compliance with the CFPB (now the Bureau of Consumer Financial Protection). This webinar will provide concrete steps that your bank or credit union can take to identify and mitigate UDAAP risks. We will also review the Federal Deposit Insurance Corporation's (FDIC) debt collection recommendations for first-party collectors, as well as compliance points related to the Fair Credit Reporting Act (FCRA), the Fair and Accurate Credit Transaction Act (FACTA), and the Fair Debt Collection Practices Act (FDCPA). We will likewise explore protections for servicemembers, as well as recent verdicts and rulings that affect how you handle slow-paying accounts.  After attending this webinar, you will be able to highlight collections "red flags" and better identify loans at risk of becoming delinquent.
